Chapter 7 eliminates credit cards, medical bills, personal loans, car loan repossessions, old utility bills, money owed to landlords.
As soon as the chapter 7 bankruptcy petition has been filed, your creditors can no longer take any actions to collect– that is, creditors can no longer call you, send you threatening letters, sue you, freeze your bank account, garnish your salary etc. This prohibition against creditor actions is called the automatic stay.
There is one straightforward court appearance– (the trustee meeting– to go over the information in your bankruptcy petition, to have you verify that the information is true and correct. The bankruptcy petition contains information on your assets, debts, income and expenses. Your employer does not get notified that you filed for bankruptcy– which takes place 4-6 weeks from when the chapter was filed.) I will be there with you for the trustee meeting.
You receive your chapter 7 discharge approximately 3 1/2 months from when the chapter 7 bankruptcy has been filed.
The whole time you are waiting for the discharge, creditors can’t do anything to collect.
